The terms governing your use of the MerchPix website, account, AI workflows, credits, and related services.

These Terms of Service ("Terms") are an agreement between you and MerchPix ("MerchPix", "we", "us", or "our"). They govern your access to and use of the MerchPix website, account, AI product-photography workflows, credits, subscriptions, and related services.
By creating an account, accessing a paid feature, or using MerchPix, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. If you use MerchPix on behalf of a company or another organization, you represent that you have authority to accept these Terms for that organization.
MerchPix provides browser-based tools that can process product images and generate or transform ecommerce visuals, including product photography, virtual try-on, ghost mannequin, background removal, and related workflows. We may add, change, limit, suspend, or discontinue features, models, integrations, or availability at any time. We do not guarantee that a particular feature, model, output format, or result will remain available.
AI-generated results are estimates created by automated systems. Results may be inaccurate, incomplete, inconsistent, or unsuitable for your intended use. You are responsible for reviewing every output before publishing, advertising, selling, or otherwise relying on it.
You must be at least 13 years old to use MerchPix. If you are under the age of majority where you live, a parent or legal guardian must supervise your use and accept these Terms where required by law.
You must provide accurate information when creating an account and keep it up to date. Keep your password and authentication details confidential. You are responsible for activity under your account and must notify us promptly if you suspect unauthorized access. You may not create an account for someone else, impersonate another person, or maintain multiple accounts to evade limits or enforcement.
Some MerchPix features use credits or a subscription plan. Free credits, purchased credits, promotional credits, plan allowances, and expiration or usage rules are shown in the product or checkout experience and may differ by plan. Credits have no cash value, are not transferable, and may not be resold or exchanged outside MerchPix.
Purchases and subscriptions are completed through the payment provider configured for the deployment, which may include Stripe, Creem, or Waffo. The provider may apply its own terms and authentication requirements. We receive transaction and subscription status needed to grant credits, provide the selected plan, maintain account records, and support billing.
You authorize us and the applicable payment provider to charge the payment method you provide for the selected plan or purchase. You are responsible for applicable taxes, accurate billing details, and ensuring that your payment method may be used. We may change plans, prices, credit amounts, or usage limits for future purchases; changes do not retroactively alter completed purchases unless required by law.
You retain your rights in images, text, and other content that you upload ("Your Content"). You represent that you own or have permission to upload, process, and use Your Content, and that doing so does not violate law, privacy rights, publicity rights, contracts, or intellectual-property rights.
You grant MerchPix a limited, worldwide, non-exclusive license to host, copy, transmit, transform, and otherwise process Your Content only as reasonably necessary to operate, secure, provide, and improve the service you request. This license ends when the relevant content is deleted, except for copies retained in backups, logs, or records required for security, legal, or operational reasons. We do not claim ownership of Your Content.
You are responsible for determining whether an AI output is lawful, accurate, non-infringing, and appropriate for your product listing or campaign. We do not promise that an output is unique or that it will not resemble other generated content. You should obtain any model, property, trademark, or other permissions required for your use.
You may not use MerchPix to:
We may refuse to process content, remove content, limit features, or suspend access when we reasonably believe these Terms, our safety requirements, or applicable law may be violated.
MerchPix and its name, logo, interface, software, documentation, templates, and underlying technology are owned by MerchPix or its licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, non-exclusive, non-transferable right to use the service for its intended purpose. You may not copy, sell, lease, sublicense, or create a competing service from MerchPix or its proprietary materials except as allowed by law or with our written permission.
MerchPix may depend on third-party hosting, storage, AI model, email, analytics, authentication, and payment services. Third-party services may have separate terms and privacy policies. We are not responsible for third-party products, outages, changes, or content, although we may help coordinate support when appropriate.
You may stop using MerchPix at any time. We may suspend or terminate access, remove content, or close an account if you violate these Terms, create risk for users or the service, fail to pay amounts due, or where necessary to comply with law or protect our rights. We may also discontinue the service or a feature.
Sections that by their nature should continue after termination will survive, including provisions concerning content rights, intellectual property, disclaimers, limitations of liability, disputes, and interpretation. Termination does not remove obligations or rights that arose before termination.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERCHPIX IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND THAT THE SERVICE OR OUTPUTS WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR SUITABLE FOR YOUR BUSINESS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERCHPIX AND ITS OPERATORS, PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
We may update these Terms when the service, providers, or legal requirements change. We will post the revised Terms on this page and update the effective date. Your continued use of MerchPix after the revised Terms become effective means you accept them. If a change materially affects your rights, we will provide notice where required by law.
These Terms are governed by the applicable laws of the jurisdiction associated with the MerchPix operating entity, without regard to conflict-of-law rules, unless mandatory local law provides otherwise. If a provision is found unenforceable, the remaining provisions will remain in effect and the unenforceable provision will be interpreted to best reflect its original purpose.
